Terms of Service

These Terms of Service ("Terms") govern your access to and use of CardVine, a product of StatZhub Consulting LLC ("CardVine," "we," "us," or "our"). By creating an account or otherwise using CardVine, you agree to these Terms. If you don't agree, please don't use the Service.

1. The Service

CardVine helps you catalog your trading card collection, see estimated market values by grade, connect with other collectors, and propose and complete trades with them. CardVine is a platform that helps collectors find and coordinate trades with each other — we are not a party to any trade you make, and we don't buy, sell, appraise, authenticate, or take custody of any cards.

2. Accounts

• You must provide accurate information when creating your account and keep it up to date.
• You're responsible for maintaining the security of your account and password, and for all activity that occurs under your account.
• You must be at least 13 years old to use CardVine.
• You may delete your account at any time; some information may be retained as described in our Privacy Policy.

3. Subscriptions and payments

CardVine offers an optional paid "Pro" subscription tier with additional features. Subscriptions are billed in advance on a recurring basis (monthly or annual, as selected) and are processed by Stripe. You can cancel your subscription at any time; cancellation takes effect at the end of the current billing period, and we don't provide prorated refunds for partial periods except where required by law.

Price estimates shown in the app are informational only, based on available market data, and are not appraisals, guarantees of value, or offers to buy or sell.

4. Trading between users

CardVine's trading feature lets you propose and accept trades with other users, and, where both sides choose to use it, pay a flat facilitation fee plus the real carrier cost for a tracked shipping label generated through our shipping partner.

• We are not a party to your trades. Trades are agreements between you and the other collector. CardVine does not inspect, authenticate, grade, insure, or guarantee the condition, authenticity, or value of any card involved in a trade.
• We never take custody of cards or cash. Cards ship directly between traders. Any cash portion of a trade is handled directly between the traders — CardVine does not process or hold cash payments as part of a trade.
• Shipping labels. The facilitation fee and shipping cost you pay through CardVine covers only the cost of generating a tracked shipping label through our shipping partner. It is not insurance, and CardVine does not guarantee delivery, and is not responsible for lost, delayed, or damaged shipments, subject to whatever coverage (if any) the carrier or shipping partner provides for that shipment.
• Your responsibility. You're solely responsible for evaluating who you trade with and what you trade. We encourage you to trade only with collectors you trust and to use the ratings and community features to make informed decisions.
• Disputes. CardVine is not responsible for resolving disputes between traders and does not guarantee any particular outcome. We may, at our discretion, suspend accounts involved in reported abuse.

5. Acceptable use

You agree not to:

• Use CardVine for any illegal purpose, or to defraud or attempt to defraud another user
• Misrepresent a card's identity, grade, authenticity, or condition when trading
• Harass, abuse, or threaten other users
• Upload content you don't have the right to share, or that infringes another party's intellectual property
• Attempt to interfere with, disrupt, or gain unauthorized access to the Service
• Use automated means to scrape or access the Service outside of its intended use

We may suspend or terminate accounts that violate these Terms.

6. Your content

You retain ownership of the content you upload to CardVine (such as card photos, posts, and messages). By uploading content, you grant CardVine a non-exclusive, worldwide license to host, store, and display that content solely as needed to operate the Service. You're responsible for making sure you have the right to share any content you upload, including respecting the intellectual property of card games, publishers, and other rights holders.

7. Third-party services

CardVine relies on third-party services — including Stripe for payments, our shipping partner for label generation, and third-party card databases for search results and images — to operate. Your use of those integrated services is also subject to those providers' own terms.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DON'T WARRANT THAT PRICE ESTIMATES ARE ACCURATE, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CARDVINE AND STATZHUB CONSULTING LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF CARDS, VALUE, DATA, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE OR ANY TRADE CONDUCTED THROUGH IT, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO CARDVINE IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

10. Termination

You may stop using CardVine and delete your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or if we reasonably believe doing so is necessary to protect CardVine or other users.

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll notify you by updating the effective date above and, where appropriate, through the Service. Continued use of CardVine after changes take effect means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws principles.
